OFFICIAL RULES — [PRIZE] GIVEAWAY

1. Promoter
This giveaway is run by [Host name] ("the Promoter").

2. Eligibility
Open to residents of [countries] aged 18 or over. Employees of the Promoter, their immediate families and anyone professionally connected with the giveaway are not eligible.

3. Promotion period
The giveaway opens on [date and time] and closes on [date and time] (UTC). Entries received after the closing time will not be counted.

4. How to enter
To enter, leave a comment on the giveaway post on Instagram. Each person may enter once; additional comments from the same account will not count as extra entries. Entries that are automated, from fake accounts, offensive, or that do not follow these rules will be excluded. No purchase is necessary to enter or win, and a purchase does not improve the chance of winning.

5. Prize
One winner will receive [prize]. The prize is non-transferable and no cash alternative is offered, except that the Promoter may substitute a prize of equal or greater value if the stated prize becomes unavailable.

6. Winner selection
After the giveaway closes, the winner will be selected at random from all eligible entries using a verifiable random draw. Backup winners may be drawn at the same time in case a winner is ineligible or does not respond.

7. Winner announcement and claiming the prize
The winner will be announced on the giveaway post and contacted by direct message from the Promoter's official account. Winners must reply within 48 hours or the prize may be awarded to a backup winner. The Promoter will never ask a winner for a password, payment or bank details.

8. Personal data
Personal details provided by the winner are used only to deliver the prize and are not shared with third parties except for that purpose.

9. Platform
This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, entrants release Instagram from any liability in connection with this promotion.

10. General
The Promoter may disqualify any entry that breaks these rules or is suspected of fraud, and may cancel or amend the giveaway if circumstances outside its control require it. Void where prohibited by law. By entering, entrants accept these rules.

11. Governing law
These rules are governed by the laws of [country / state].

A starting template, not legal advice. Promotion law differs by country and state — check yours, especially for high-value prizes.

What every giveaway's rules need

  • Who runs it — the host's name and a way to contact them.
  • Who may enter — countries or states, minimum age, and who is excluded (staff, family).
  • When it opens and closes — date, time and time zone.
  • How to enter, and how many entries each person gets.
  • The prize, its approximate value, and whether a substitute is possible.
  • How the winner is chosen (a random draw from eligible entries) and when.
  • How winners are told, how long they have to reply, and what happens if they do not.
  • "No purchase necessary" — in many countries a draw that requires payment is an illegal lottery.
  • The platform's release or "not associated with" statement.

After the giveaway closes

Draw exactly the way your rules say: load every comment, apply the entry rules you published (keyword, tags, one entry per person, closing time), and pick at random from what is left. Draw backups at the same time so a winner who never replies does not mean a second, private pick.

CommentsPickerPro does that for all five platforms and gives you a certificate with a verification code, so entrants can check the draw matched your rules.

Giveaway rules on each platform

Instagram giveaway rules

Instagram's promotion guidelines make you responsible for running the giveaway lawfully. The rules must include a complete release of Instagram by each entrant and say the promotion is not sponsored, endorsed, administered by or associated with Instagram. You must not encourage people to tag content inaccurately — asking entrants to tag friends in a comment is fine; asking them to tag themselves in photos they are not in is not.

Facebook giveaway rules

Facebook's Pages terms say personal timelines and friend connections must not be used to run a promotion. "Share on your timeline to enter", "share to a friend's timeline" and "tag your friends to enter" are not allowed as entry rules; commenting or liking on your Page post is. The rules need a release of Facebook and a statement that the promotion is not associated with Facebook. Run it from a Facebook Page, not a personal profile.

YouTube giveaway rules

YouTube lets creators run contests but makes them responsible for the rules and the law. Publish official rules, state eligibility and the prize, and make clear YouTube is not a sponsor. Subscribing, liking or sharing must not be a condition of entry — invite it, never require it.

TikTok giveaway rules

You are responsible for the giveaway's rules and legality. Disclose sponsored or partnered giveaways with TikTok's branded content toggle, and do not ask for personal details in comments — contact the winner by direct message.

X (Twitter) giveaway rules

X's rules prohibit encouraging people to create multiple accounts or to post the same content repeatedly to enter. Say "one entry per account" and enforce it, and keep duplicate replies out of the draw.

Questions about giveaway rules

Do I need official rules for a social media giveaway?

In practice, yes. Instagram, Facebook and YouTube all expect the host to publish rules, and in many countries and US states clear terms — eligibility, dates, prize, how the winner is chosen — are a legal requirement for prize promotions.

Where should I put the giveaway rules?

Put a short version in the post itself (how to enter, closing time, who may enter, the release line) and link to the full official rules on your website, link in bio, or a pinned comment.

Is "no purchase necessary" required?

In most places a prize draw that requires a purchase or payment to enter counts as a lottery, which is regulated or illegal. Keeping entry free — and saying so — is what keeps a giveaway a giveaway.

Is this generator legal advice?

No. It is a starting template that covers what platforms and most giveaways need. Promotion law varies by country and state, and high-value prizes can have registration, bonding or tax rules — check locally.
